Before you commission me it’s important to note:

- My artstyle is sometimes messy! I don’t usually do traditional lineart but enjoy colouring over, adding details as I go.
- My schedule may be hectic due to irl circumstances or health issues (i get sick easily). Commission start times are not always guaranteed and there might be slight delays. Delays may happen and I will always inform you when it happens. Tho I usually still get things done before the delivery date!
- I do not accept clients who support and generate AI references themselves. It’s fine if it’s in your moodboard / reference list as long as it’s small, not self-generated and you are not actively supporting the use of it.

TERMS OF SERVICE

Please read the following thoroughly and carefully.

By commissioning me (the Artist), you (the Client) agree to the following:‣ You, the Client, are responsible for reading the service description fully and carefully.‣ I, the Artist, reserve the right to decline any commission inquiries and clients for any reason.‣ You must credit me whenever the artwork is used or posted publicly.‣ Selling, reselling and tracing the whole or any part or asset of the commissioned work is strictly prohibited.‣ You are not allowed to redistribute or use my art in any external projects unless otherwise discussed.‣ Process may be streamed or shared unless I am under an NDA.‣ Inappropriate messages, spam messaging for attention and harassment will result in a termination of the project without full refund.‣ Using any of my works for NFT, ANY AI OR ANYTHING RELATED IS STRICT PROHIBITED. You WILL be blacklisted.

PAYMENT

‣ I accept paypal only.‣ Invoices must be paid in full before I start on the commission unless a payment plan has been mutually agreed upon.‣ Payment plans are available for larger projects (50% upfront, 50% halfway).‣ For payment plans, please pay the second portion in a timely manner after the invoice is sent to avoid delays and rescheduling.‣ If no payment is made within 48h, your request may be pushed back to avoid backlog and your commission may be rescheduled to a later date.‣ All payments are final, no refunds. By commissioning me you agree to not file any chargebacks at anytime during or after the commission or you will loose all rights to the commissioned work.

CANCELLATION & REFUND

‣ Full refunds are available if no progress was made on the Client’s commission.‣ No refunds after I have started on the sketches / drafts.‣ In the case where I am unable to continue with a commission through no fault of the Client, a refund will be offered depending on the commission type and the progress made.

DEADLINES & DELIVERY

‣ You must disclose any deadlines when making the initial request / prior to payment. You may not change or add a deadline after the commission begins.‣ Depending on current queue and the complexity of the project, turnaround time may range from 1 month to 5 months.‣ I reserve the right to change the “Guarantee Delivery Date” on VGen anytime if the Client fails to respond and/or make a payment in a timely manner. Due to this guarantee delivery dates are set to be months ahead.‣ Whether a rush fee is required to meet a certain deadline is solely based on my discretion.‣ All deliverables are digital. Once delivered, I am not responsible for any files lost. I have limited storage space on my tablet, I cannot preserve everyone’s files indefinitely.

REVISIONS

‣ No revisions or changes after I deliver the final files unless there is a large mistake. If you want changes for any other reason, there will be a fee.‣ Any major revisions MUST be made during the sketch phase. Major revisions post sketch / draft phase will incur fees.‣ Minor revisions are allowed in the line + base colour phase. Rendering revisions can be requested during render.‣ Please try to request revisions all at once, to save unnecessary back and forths.‣ ANY revisions after the final phase approval WILL incur fees.‣ For Skeb / Surprise me / Omakase type commissions, only mistake corrections are allowed (does not apply if the references to client provides are inaccurate).

COMMUNICATION

‣ All communication will be made though one of the following methods: Twitter DMs, VGen DMs, Discord or email.‣ Several work in progress (WIP) files will be sent throughout the process. For more detail about the progress please read: https://rinnori.carrd.co/#process. This does not apply for skeb / surprise me projects.‣ Do not rush me or pressure me to send you updates everyday. I have a schedule and I work at my own pace. I will send you at least 1 update every week or two on the current progress. I will also reply to commission related questions/messages within 1-2 days.‣ The Client must remain reasonably communicative throughout the whole duration of the commission. If the Client has been non-communicative for more than 5 days (2 days for rushed projects), I will proceed without the Client’s input for that stage of the commission.‣ If the Client is uncommunicative for 2 weeks straight, the commission will be marked as complete at the current stage and delivered to the Client.

RIGHTS & USE

‣ I retain all rights to the copyright, ownership, and redistribution of the commissioned work(s). I have the right to sell, redistribute, reproduce and use the commissioned piece for sale or promotion.‣ Your use of the commissioned work(s) must be clearly declared when submitting a request. Any use of the commissioned work(s) outside of the originally declared purpose without my explicit consent is prohibited.‣ I DO NOT ALLOW any of my artworks be used for artificial intelligence (AI) and non-fungible tokens (NFTs). Using the commissioned piece for AI and NFTs is STRICTLY PROHIBITED. DO NOT put any of my artworks, vtuber models or designs through ANY form of AI. You WILL be blacklisted.‣ All work is by default personal use only unless discussed or specified in the commission description. You may purchase Commercial: Digital and/or Commercial: Merchandise rights anytime before, during or after the commission. For more information refer to the following link: https://rinnori.carrd.co/#commercial-use.‣ I reserve the right to post any finished commission work on my social media or portfolio anytime unless under a NDA.

If you fail to abide by these terms of service, I have the right to revoke your usage rights of the commissioned piece without any refund or compensation. Violating any aspect of the Terms of Service will result in a blacklist. The blacklist may be shared publicly or privately to other artists.

Personal Rights and Use

Personal artwork is artwork that is used for personal purposes only with no monetization, sales or promotion. The artwork shall not be used to make any profits directly or indirectly.

Uses for personal artwork may include:
✦. Utilizing the artwork for profile icons.
✦. Personal wallpaper, having it printed and framed.
✦. Sharing on social media with no direct or indirect link to a monetization source.
✦. Use for weekly schedules OK
Example: A content creator may use the artwork for their profile icon and sharing it on Twitter. However, they are not allowed to use it for promotional content such as stream backgrounds or merch ads / big stream events.

Commercial: Digital Rights and Use

Commercial: Digital rights are rights purchased for commercial use digitally. Artwork with commercial rights can be used for promoting the one's own business directly and indirectly.

Uses for commercial: digital artwork may include:
✦ Background, panels, showcases, thumbnails etc.
✦ Using for digital content related purposes.
Example: The artwork is used as a stream loading screen for a Twitch channel as well as the image for a subathon promotion sheet. It can be used to promote merchandise but not on the merchandise itself.

Commercial: Merchandise Rights and Use

Commercial: Merchandise rights are rights purchased for creating physical and digital product with the intent to distribute or sell. Artwork with commercial: merchandise rights can be used to make merchandise for one's own business.

Uses for commercial: merchandise artwork may include:
✦ Production of merchandise for selling (shirts, keychains, cups, prints etc).
✦ Production for sale or distribution as a digital product for profit (animated wallpaper, ebooks, apps, games etc).
Example 1: The artwork is used to create keychains and t-shirts to sell or distribute to others in a convention or online shop.
Example 2: The artwork / design is used to create digital books / games that is going to be sold or locked behind a paywall.Note: Usually Commercial: Digital rights needs to be purchased with Commercial: Merchandise rights if you wish to promote any of your merchandise with my art in any form.

Note: I have the right to decline ANY change requests or charge a fee for ANY changes after the "Progress C" phase is approved / the files are ready / are delivered. Please respect my time.
